Welcome to SHO MODERN LLC. By using our website and purchasing our products, you agree to the following Terms of Service.

1. Acceptance of Terms

By accessing and using our website and services, you agree to comply with these Terms of Service. If you do not agree with any of these terms, please do not use our website or services.

2. Eligibility

You must be at least 18 years of age to use our services. By agreeing to these terms, you confirm that you are of legal age.

3. Products and Pricing

All product descriptions, prices, and availability are subject to change without notice. While we strive to provide accurate information, errors may occur, and we reserve the right to correct them, including pricing errors, at any time. Prices do not include taxes, duties, or shipping charges, unless otherwise stated.

4. Orders and Payment

Orders can be placed via our website. Payment must be made in full at the time of purchase. We accept Credit Cards, Debit Cards, SHOP Pay, Google Pay and PayPal. Orders are subject to availability, and we reserve the right to refuse or cancel any order for any reason.  If you would like to discuss other payment options, please contact info@shomodern.com.  Inventory is not secured until payment is received.

5. Shipping and Delivery

Shipping

We ship both domestically and internationally.  However our website only allows for purchases shipped to the continental United States.  Shipments to Alaska, Hawaii and Internationally will be coordinated directly with SHO MODERN Customer Service which can be contacted at +1 949-643-1000. Inventory is not secured until payment is received.  

We have two primary shipping options; 

  • Standard Curbside - Item is removed off of the delivery truck to curbside or similar location in front of delivery address.  It is the customer's responsibility to bring the item from that location inside the delivery address.  If the item cannot be delivered because of customer missed appointment, no legal adult available to sign delivery receipt, or other customer issue which includes refused delivery, the customer may bear additional costs to redeliver or return freight.  See additional potential delivery issues below. The Delivery Company will not carry the item into your home or unpack it.  Once the item is delivered curbside, it is the customer's responsibility to move it into the home. This may require assistance or tools, especially for larger furniture pieces. The delivery team is not responsible for setting up, moving, or unpacking the item inside the residence.  SHO MODERN can arrange for White Glove or a higher level of delivery service but this would be at additional customer costs.  To discuss additional delivery options, please contact SHO MODERN at info@shomodern.com.
  • White Glove - Delivery to designated room of choice inside your home (up to 2 staircases) + Packaging Removal+ Basic tool assembly up to 30 minutes with no mounting.  It is the customer's responsibility to assure the item can be delivered safely by measuring path to desired location in home including stairwell and elevator dimensions.  Many buildings, especially in urban areas or commercial spaces, require a Certificate of Insurance (COI) for deliveries. The COI is a document provided by the delivery company that verifies their insurance coverage, protecting the building management and residents from liability in case of damage or injury during delivery.

    If a COI isn't provided in advance or the delivery company doesn't meet the building's insurance requirements, the delivery may be denied or delayed at Customer cost.

If delivery is hindered due to circumstances outside of the delivery parameters, the customer will bear any additional costs. Some issues that can impact delivery:

Delivery for furniture can be hindered by several factors, including:

  • Restricted Access: Narrow or blocked streets, low-hanging power lines, or other obstructions may prevent delivery trucks from accessing the curb.
  • Parking Limitations: Lack of available space for the truck to park near the delivery location can make curbside delivery impossible.
  • Customer’s Residence Restrictions: Certain neighborhoods or buildings may have delivery restrictions, such as no-truck zones or limited delivery hours.
  • Weather Conditions: Severe weather, such as heavy rain, snow, or extreme heat, may lead to the delay or cancellation of curbside delivery.
  • Regulatory or Legal Restrictions: Local laws or homeowners' association rules might prohibit certain types of delivery vehicles or curbside unloading.

    SHO MODERN LLC is not responsible for delays caused by third-party shipping carriers, customs processes, or unforeseen circumstances such as natural disasters.

    Shipping Costs

    Shipping costs will be calculated and displayed at checkout. Shipping fees are non-refundable, except in cases where the item arrives damaged or there is a shipping error on our part.  

    Order Processing

    All orders are processed within 3 business days of receiving your order. Once your order is shipped, you will receive a tracking number via email. Please note that during high demand periods or due to uncontrollable events, there may be delays in processing.

    Delivery Issues

    If you have not received your order within the expected delivery window, please contact us at info@shomodern.com or +1 949-643-1000 with your order number and tracking information. We will work with you and the shipping carrier to resolve any issues.

    Damaged or Defective Products

    If your product arrives damaged or defective, we sincerely apologize for the inconvenience. Here’s how we handle these situations:

    Reporting Damage:

      • Inspect your order upon reception. If you notice any damage, please notify us immediately within 48 hours of receiving the product.  
      • If product damage is not reported within 48 hours or the delivery receipt is signed with no damage noted any freight claim will be waived.
      • To report damage, contact us at  info@shomodern.com or +1 949-643-1000 with the following details:
        • Order number
        • Photos of the damaged product and packaging
        • A brief description of the issue
    Resolution Process:
    • Once we receive your report, we will assess the situation and, depending on the severity of the damage, offer one of the following resolutions and are all at the discretion of SHO MODERN LLC:
      • Replacement: We will send a replacement of the damaged item at no additional cost.
      • Repair: If possible, we may arrange for a professional repair of the damaged product.
      • Refund: In cases where a replacement or repair is not feasible, we will issue a full or partial refund based on the extent of the damage.                                                               

    Shipping for Replacements or Repairs:

    • SHO MODERN LLC will cover the cost of shipping for any replacement or repair due to damage occurred during shipping.  Return shipping labels will be provided as necessary.
    • You must retain all shipping materials for inspection as well as return shipping if necessary. 

    Non-Delivery or Lost Items

    In the rare event that your item is lost during transit, we will work with the shipping carrier to investigate the issue. If the item is confirmed lost, we will arrange for a replacement or a full refund.

    Shipping Delays

    General Shipping Timeframes
    • We strive to ship all products within the estimated shipping time frames provided at the time of purchase.  SHO MODERN is not liable for any damages caused by shipping delays.
    • Shipping times may vary based on your location, product availability, and the shipping method selected.
    Delays Due to Unforeseen Circumstances
    • Shipping delays may occur due to factors beyond our control, including but not limited to weather conditions, natural disasters, customs inspections, carrier delays, and global or local disruptions (e.g., pandemics, strikes, etc.).
    • In the event of such delays, we will notify you as soon as possible and provide updates on the status of your order.
    Notification and Communication
    • We will make reasonable efforts to communicate any known shipping delays via email or other contact information provided during the checkout process.
    • You are responsible for providing accurate and up-to-date contact information to ensure proper communication regarding your order.

    Customer Responsibility for Shipping Delays

    • Any delays resulting from incorrect or incomplete shipping addresses provided by the customer are not the responsibility of our company.
    • If an order is delayed or returned due to such errors, the customer may be responsible for additional shipping charges or address correction fees.
    Customs and International Shipping
    • For international orders, shipping times may be extended due to customs inspections and processing.
    • The customer is responsible for any customs duties, taxes, or additional fees imposed by the destination country.
    • Our company cannot be held liable for delays caused by customs clearance procedures.
    Refunds and Cancellations
    • Refunds for shipping delays will not be issued unless the delay exceeds a reasonable period, as determined by our company’s policies.
    • In case of significant delays, you may be eligible for a partial refund, store credit, or the option to cancel your order in accordance with our terms.
    • All refund or cancellation requests must comply with our standard return and refund policies.
    Shipping Carrier Responsibility
    • Once your order has been handed over to the shipping carrier, we are not responsible for any delays caused by the carrier.
    • We will work with the shipping carrier to resolve issues when possible, but delays caused by the carrier are beyond our control.

    Force Majeure

    • Our company is not liable for shipping delays or failure to deliver due to events beyond our reasonable control, including acts of God, war, terrorism, labor strikes, pandemics, governmental actions, and other unforeseen circumstances.

    6. Returns and Refunds

    We offer a 7 day return policy. To be eligible for a return, items must be unused and in their original condition and packing materials. Returns are subject to inspection, and refunds will be issued once the return is processed. Return shipping costs are the responsibility of the customer, unless the item is defective or incorrect.

    7. Warranty

    All products are covered by a one year warranty against manufacturing defects. This warranty does not cover normal wear and tear, misuse, or accidental damage.

    8. Intellectual Property

    All content on this website, including but not limited to text, graphics, logos, and images, is the property of SHO MODERN LLC and is protected by intellectual property laws. You may not use any content from our website without our express written permission.

    9. Limitation of Liability

    SHO MODERN LLC is not liable for any indirect, incidental, or consequential damages arising out of your use of our products or website. Our liability is limited to the amount you paid for the product.

    10. Governing Law

    These terms are governed by the laws of the state of California, without regard to its conflict of law principles.

    11. Changes to Terms

    We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the revised terms.
